Supreme Court hears bail plea in case over obscene posts against women

ISLAMABAD: The Supreme Court on Monday heard a bail application filed by a suspect accused of uploading obscene and derogatory posts against women on social media.

A two-member bench comprising Jamal Mandokhail and Musarrat Hilali conducted the hearing. The accused, Tayyab Dar, is named in the first information report, according to complainant’s counsel Rizwan Abbasi.

Abbasi told the court that evidence was available showing that objectionable material was circulated on social media from the accused’s account. He said the content related to women was so offensive that it could not even be read aloud in court.

Counsel for the accused argued that the posts were uploaded by the suspect’s son using Facebook, adding that a case could not be made against a father for the actions of his child. He further claimed that the SIM card registered in the accused’s name was being used by his son.

Justice Mandokhail remarked that if the matter was so serious, children should not be given mobile phones. Justice Musarrat Hilali questioned whether no one had informed the accused that inappropriate content was being shared from his number.

The complainant’s counsel said investigations showed that both the father and son had been using the mobile phone. Justice Musarrat Hilali observed that all documentary evidence presented so far pointed towards the accused.

Justice Mandokhail noted that offences involving the dignity of women had to be dealt with strictly and said that no one should be allowed to malign the honour of others.

Rizwan Abbasi requested additional time to submit further documents related to the accused. Accepting the request, the court granted time for submission of the documents and adjourned the hearing until next week.
