JCP approves transfer of three IHC judges to other high courts

ISLAMABAD: The Judicial Commission of Pakistan (JCP) on Tuesday approved the transfer of three judges from the Islamabad High Court to other high courts, following a meeting held at the Supreme Court of Pakistan.

The JCP meeting, chaired by Chief Justice of Pakistan in his capacity as commission head, considered proposals under Article 200 of the Constitution regarding the transfer of judges between high courts.

According to the decisions taken, Justice Mohsin Akhtar Kiani will be transferred to the Lahore High Court, Justice Babar Sattar to the Peshawar High Court, and Justice Saman Rafat Imtiaz to the Sindh High Court, with all three transfers approved by majority.

The meeting was convened by the commission’s secretary under Article 175A after the chairman declined to call it despite a requisition by one-third of the members.

Proposals seeking the transfer of Justice Arbab M. Tahir to the Balochistan High Court and Justice Khadim Hussain Soomro to the Sindh High Court were withdrawn by the members who had initially moved them.

The commission also decided, by majority, that any vacancy arising from the transfer of a judge would be filled through further transfers, and not treated as a vacancy for fresh appointments.
